1. Scope and relationship with general Terms
These AI Terms of Use (“AI Terms”) govern use of Nong Lilly and other artificial intelligence-enabled chat or assistant features operated by LITALK Education through its public website, Ask services, Student Portal and authorised staff interfaces (collectively, the “AI Services”). These AI Terms supplement the general Terms of Service. In the event of an inconsistency concerning a matter specific to an AI Service, these AI Terms shall prevail to the extent of that inconsistency; otherwise, the general Terms of Service remain applicable.
2. Acceptance and eligibility
A user accepts these AI Terms by selecting the applicable acceptance control, submitting a message after being presented with these AI Terms, or otherwise using an AI Service in circumstances where acceptance is clearly indicated. Where a user lacks legal capacity to accept these AI Terms independently, acceptance must be provided or authorised by a parent, guardian or other person legally empowered to act for that user to the extent required by applicable law. This contractual acceptance is distinct from consent under data-protection law.
3. Nature and limitations of AI outputs
AI outputs are generated automatically and may be incomplete, inaccurate, outdated, misleading or otherwise unsuitable for a particular purpose. Unless expressly confirmed by an authorised LITALK representative, an AI output does not constitute an official statement, contractual amendment or binding commitment of LITALK. Users remain responsible for independently verifying information that may materially affect lessons, schedules, credits, payments, examinations, admissions or other important decisions. AI Services do not provide medical, legal, financial, immigration or other regulated professional advice.
4. Scope of account access
The scope of an AI Service varies by interface. Public website and general Ask features are not designed to access student-account data. An authenticated Student Portal AI Service may use limited account context relevant to the signed-in student's request, as described in the AI Privacy Notice. Staff-facing AI Services remain subject to the access permissions applicable to the authorised staff account. Users must not attempt to obtain or induce disclosure of information concerning another student, parent, staff member or other person without lawful authority.
5. Prohibited and restricted use
A user must not use an AI Service to violate law or the rights of another person; obtain unauthorised personal or confidential information; circumvent, override or extract system instructions, safeguards or usage controls; interfere with service availability; engage in harassment, threats, unlawful discrimination or other abusive conduct; submit unlawful or infringing content; use automated means at a volume that materially interferes with the Service; misrepresent AI-generated work as independently produced where such conduct is prohibited by an educational institution or assessment rule; or resell or commercially exploit access without written authorisation.
6. Sensitive information
Users should not submit passwords, one-time passwords, complete payment-card or bank-account credentials, national identity or passport numbers, or sensitive personal data unless an authorised LITALK feature expressly requests the information for a lawful and necessary purpose. If an AI output appears to request credentials or other information that is not reasonably necessary, the user should discontinue the interaction and contact LITALK through an official support channel.
7. User content and AI outputs
The user retains any rights the user lawfully holds in content submitted to an AI Service. LITALK may process such content only in accordance with the applicable agreement and privacy documentation. AI outputs may not be unique or original, and substantially similar outputs may be generated for other users. To the extent permitted by law, LITALK does not warrant that an AI output is non-infringing, suitable for publication or capable of exclusive ownership. Users are responsible for reviewing an output before publication, submission or other reliance.
8. Availability, usage limits and suspension
AI Services are provided subject to operational availability and may be subject to usage limits. LITALK may modify reasonable limits or temporarily restrict, suspend or withdraw an AI Service where necessary for maintenance, cost control, security, safety, legal compliance, prevention of misuse or circumstances beyond reasonable control. Where appropriate and practicable, notice may be provided. Suspension or withdrawal of an AI Service does not, by itself, terminate unrelated educational Services.
9. Liability
To the fullest extent permitted by applicable law, LITALK shall not be liable for loss arising solely from a user's unreasonable reliance upon an AI output, use of an AI Service in breach of these AI Terms, or temporary unavailability of an AI Service where LITALK has exercised reasonable care in the circumstances. Nothing in these AI Terms excludes or limits liability, statutory remedies or consumer rights that cannot lawfully be excluded or limited. The liability provisions of the general Terms of Service also apply.
10. Privacy
Processing of personal data in connection with AI Services is governed by the Privacy Policy, AI Privacy Notice and, where relevant, the Cookie & Local Storage Policy. Acceptance of these AI Terms shall not be construed as consent to personal-data processing where applicable law requires a separate valid consent.
11. Amendments and contact
LITALK may amend these AI Terms to reflect changes in law, regulatory requirements, technology or the AI Services. Where a material amendment requires renewed acceptance or additional notice, the relevant mechanism will be provided before continued use as required. Questions or reports concerning an AI Service may be submitted to support@litalkeducation.com or through LITALK's official support channels.
